Lodge No. 5 of the Fraternal Order of Police v. City of Philadelphia, 12-1516
Order granting summary judgment to the City of Philadelphia to maintain a 1951 Home Rule Charter that prevented members of the Philadelphia Police Department from making contributions to their union's political action committee is reversed and remanded for judgment to be entered in favor of the appellants, where, given the lack of fit between the City's stated objectives and the Charter, the ban on such contributions is an unconstitutional violation of the First Amendment.
