US v. Travillion, 12-4184

The district court's decision denying defendant's post-trial motion for relief under 28 U.S.C. 2255 is affirmed, where: 1) trial counsel was not ineffective for failing to cross-examine a government witness with certain inconsistent statements because the outcome of the trial was not prejudiced by counsel's actions; 2) trial counsel was not ineffective for failing to file a pre-trial motion challenging the indictments charging defendant with two conspiracies as violative of double jeopardy; and therefore, 3) no fundamental defect which inherently results in a complete miscarriage of justice has been shown to exist and the result of the trial is reliable.
