Foglia v. Renal Ventures Management, 12-4050
Dismissal of a qui tam claim brought under the False Claims Act, arising out of claims submitted or presented to Medicare by defendant that plaintiff alleges are fraudulent, is reversed and remanded, where: 1) under the heightened pleading requirements of Federal Rule of Civil Procedure 9(b), it is sufficient for a plaintiff to allege particular details of a scheme to submit false claims paired with reliable indicia that lead to a strong inference that claims were actually submitted; and 2) plaintiff has provided sufficient facts to meet the requirements under Rule 9(b).
