Bryan v. Erie County Office of Children and Youth, 12-4623
In an action alleging that defendants placed plaintiff's son in harm's way by failing to disclose the violent history of a boy that plaintiffs adopted, who then assaulted their son, the district court erred in ruling that it could not resolve whether to enforce the parties' high-low settlement agreement or the jury's verdict in favor of plaintiffs, where: 1) the case had not been dismissed, nor had the jury's verdict been marked satisfied; 2) the case should have remained with the district court; and 3) ancillary jurisdiction exists for post-judgment proceedings related to the enforcement of the judgment and the district court had jurisdiction to decide whether or not to enforce the parties' settlement agreement.
