Nuveen Municipal Trust v. Withumsmith Brown PC, 10-4633

New Jersey’s Affidavit of Merit Statute (AOM Statute), which requires certain claims against professionals to include an affidavit from an independent professional attesting to the claims' merit, does cover plaintiff's action seeking money damages for fraud, negligent misrepresentation, and malpractice, allegedly committed by two professional firms, and therefore the district court correctly held that the AOM Statute applies and that plaintiff's noncompliance with the AOM Statute warranted dismissal of its case.
