United States Third Circuit

Cadapan v. Attorney General United States, 13-2944

A petition for review of the decision by the Board of Immigration Appeals (BIA) finding petitioner removable for having been convicted of an "aggravated felony" is denied, where: 1) petitioner's conviction under the Pennsylvania indecent assault statute qualifies as aggravated felony under the Immigration and Nationality Act; and 2) petitioner failed to exhaust his administrative remedies with regard to his argument whether or not he was ever "admitted" to the United States.
