Reifer v. Westport Insurance Corp., 13-2880
In a declaratory judgment action brought by plaintiff against defendant-insurer to establish coverage of her claim against the attorney-insured for legal malpractice, for which plaintiff had obtained a judgment, the district court's orders declining to exercise jurisdiction over the matter that defendant had removed to federal court, and remanding it back to state court, are affirmed, where: 1) the Declaratory Judgment Act applies; and 2) the district court did not abuse its discretion in declining jurisdiction.
