Semper v. Gomez, 13-2582
Dismissal of plaintiff's complaint alleging that defendants terminated him from his parole officer position without cause and without a pre-termination hearing in violation of the Due Process Clause of the Fifth Amendment, is: 1) affirmed insofar as it dismissed plaintiff's official capacity claim against defendant Chief Judge Gomez, his claim against the United States, and his claim for a writ of mandamus for lack of subject matter jurisdiction; and 2) remanded with instructions to dismiss plaintiff's individual capacity claim against defendant Chief Judge Gomez for lack of subject matter jurisdiction.
