Glenn v. District Attorney Allegheny County, 12-4333

The district court's denial of a petition for a writ of habeas corpus challenging petitioner's murder conviction is affirmed, where: 1) the superior court did not violate petitioner's due process rights by refusing to grant his motion for a mistrial after a witness proffered contradictory testimony because it is presumed that the jury was able to follow the instructions to disregard the witness' unreliable testimony, so this testimony did not render petitioner's trial "fundamentally unfair;" and 2) petitioner's claim of ineffective assistance of counsel fails.
