In a dispute over the sale of a small island in the U.S. Virgin Islands and an accompanying launching point, where deposits made by the buyers were released by the escrow agent to the sellers but the sale was never consummated: 1) plaintiff Taylor is entitled to recover the $1.5 million deposit in restitution; and 2) the tort claims are barred by the gist of the action doctrine.
