Sheet Metal Workers International Association v. E.P. Donnelly, Inc., 10-2201

In consolidated appeals arising out of a construction trades jurisdictional dispute concerning whether certain work on a public building should be conducted by sheet metal workers or by carpenters: 1) petitioner's petition for review of the National Labor Relations Board's (NLRB) finding that petitioner violated the National Labor Relations Act by maintaining a section 301 suit against defendant construction companies following the NLRB's assignment of the disputed work to the carpenters; 2) the NLRB's petition for enforcement of its decision and order is granted; and 3) the district court's judgment in favor of petitioner on its breach of contract claims against defendant construction companies is vacated and remanded.
