US v. Ward, 12-1511
Defendant's sentence for multiple counts involving shipping child pornography and inducing a minor to engage in sexually explicit conduct, is affirmed, where: 1) there is no right to deliver an unsworn allocution; 2) given the lack of evidence or argument that there was actual vindictiveness on the part of the district judge, the district court did not err in determining to increase defendant's fine; 3) given the extensive evidence of a pattern of prohibited sexual conduct, the district court did not err in imposing the five level enhancement under the Sentencing Guidelines; and 4) defendant's remaining arguments fail.
