United States Third Circuit

Papotto v. Hartford Life & Accident Insurance Company, 12-1261

An appeal from the district court's order remanding a life insurance benefits dispute case to the ERISA Plan Administrator for a determination of whether there was a causal connection between the deceased's intoxication and his death, is dismissed for lack of jurisdiction because: 1) the remand order is not immediately appealable as a final judgment; and 2) the collateral order doctrine does not apply.
