Dismissal of a qui tam suit brought under the False Claims Act (FCA), alleging that defendants fraudulently billed the United States for the unperformed review of benefit claim denials that was required by the Medicare Act, Department of Health and Human Services regulations, and their Government contracts, is affirmed, where the district court did not err in concluding that it lacked jurisdiction because: 1) the allegations against defendants were based on certain prior public disclosures; and 2) plaintiff was not an original source of that information.
