District court's judgment of acquittal on charges of presenting a materially false statement in an immigration form, on grounds that the statute of conviction required that the statement was made under oath, is affirmed under the rule of lenity, even though it is grievously ambiguous as to whether the "knowingly presents" clause requires an affirmation made under oath.
