United States Third Circuit

Ball v. Famiglio, 12-1067

Plaintiff-inmate's request to proceed in forma pauperis (IFP) on appeal from the grant of summary judgment to defendants in her pro se action pursuant to 42 U.S.C. section 1983, in which she alleges deliberate indifference to her medical needs in violation of the Eighth Amendment, is denied, where: 1) plaintiff is not eligible for IFP status because she had accrued three "strikes" under the Prison Litigation Reform Act and 2) she was not in imminent danger of serious physical injury when she brought these appeals.
