Washington v. Secretary, Pennsylvania Department of Corrections, 12-2883

The district court properly granted the petition for writ of habeas corpus challenging petitioner's convictions for second-degree murder, robbery, and criminal conspiracy where: 1) the trial court allowed into evidence the redacted confession of a jointly-tried non-testifying coconspirator's confession which replaced petitioner's name with "someone I know" or "the driver;" 2) no reasonable reading of the Supreme Court's Confrontation Clause jurisprudence would permit the introduction of the redacted confession allowed in this case; and 3) that error substantially and injuriously affected petitioner's case.
