Defendant's conviction for falsely and willfully representing herself as a United States citizen is affirmed, where: 1) under the language of 22 U.S.C. section 2705, a passport constitutes conclusive proof of citizenship only if the passport was issued to a U.S. citizen; and therefore, 2) since defendant was not a U.S. citizen, the district court did not err in denying defendant's motion for acquittal or in refusing to adopt defendant's proposed jury instruction regarding the legal effect of her passport.
