United States Third Circuit
Johnson v. SmithKline Beecham Corp, 12-2561
In a case seeking redress for lifelong physical and emotional suffering arising out of a now-banned drug thalidomide, appeal of the District Court's denial of plaintiff's motion to remand this case to Pennsylvania state court, on grounds that the Court lacks subject matter jurisdiction over the claims because the parties do not have complete diversity of citizenship, is affirmed where the District Court's assessment of citizenship was correct, and none of the defendants is a citizen of the same state as either plaintiff.
