United States Third Circuit
Morrow v. Balaski, 11-2000
Judgment dismissing action brought under 42 U.S.C. 1983 alleging that defendant-school officials denied plaintiffs substantive due process under the Fourteenth Amendment by not protecting plaintiff-students from abuse inflicted by fellow student, is affirmed, where the allegations do not establish the special relationship or the state-created danger that must exist before a constitutional duty to protect arises under the Fourteenth Amendment.
