Lupera-Espinoza v. Attorney General of the United States of America, 12-2007
The Board of Immigration Appeals' (BIA) decision ordering petitioner deported is affirmed, where: 1) the BIA correctly held that petitioner was ineligible to seek relief under former Immigration and Nationality Act section 212(c) because he had served more than five years for an aggravated felony by the time the BIA affirmed the Immigration Judge's deportation order; and 2) petitioner did not suffer any due process violations during the course of his deportation proceedings.
