US v. Turner, 12-1420

Conviction and sentence for conspiracy to defraud the United States, and order to pay $408,043 in restitution to the Government, are affirmed, where the district court did not err: 1) in admitting recorded conversations between defendant's co-conspirator and an undercover Internal Revenue Service (IRS) agent; 2) in admitting foreign bank documents that the IRS seized from defendant's co-conspirator's residence and office; and 3) in requiring defendant to pay restitution without making a finding regarding his ability to pay.
