United States Third Circuit

Grant v. Lockett, 10-3804

The district court is directed to grant a conditional writ of habeas corpus, where: 1) the district court properly rejected petitioner's prosecutorial misconduct claim because government is not obliged to furnish a defendant with information which he already has or, with any reasonable diligence, he can obtain himself; but 2) petitioner was denied his Sixth Amendment right to effective assistance of counsel.
