US v. Sussman, 09-4023
Judgment of conviction and sentence for theft of government property and obstruction of justice related to and Federal Trade Commission civil judgment against him for his abusive debt collection activities, is affirmed, where: 1) there was sufficient evidence for the jury to find that the coins were money or a thing of value of the United States at the time that defendant removed them from the safe deposit box, and that defendant interfered with due administration of justice when he removed the gold coins and retained them for 10 months; 2) defendant fails to make specific showing of prejudice attributable to the absence of certain transcripts; 3) the district court did not abuse its discretion in admitting redacted documents from the FTC civil case rather than confining the reference to them to a stipulation of their existence; and 4) there was no error in the instructions to the jury sufficient to warrant reversal.
