Sherzer v. Homestar Mortgage Services, 11-4254
To effectively rescind a loan under the Truth in Lending Act when a lender fails to provide material disclosures as required, a borrower need only send a valid written notice of rescission within the three year statute of limitations; a borrower does not also need to file suit within the three-year period.
