United States Third Circuit

In re Diet Drugs, 12-1180

Plaintiffs' suit for injuries from primary pulmonary hypertension allegedly caused by defendants' diet drugs was properly enjoined by the district court because it did not qualify under the nationwide class action Settlement Agreement as a cause of action that could proceed despite the terms of the settlement, and plaintiffs waived their argument regarding reformation of the Settlement Agreement.
