US v. Diallo, 10-3771
In appeal of sentence for knowingly possessing 15 or more counterfeit credit cards with the intent to defraud, judgment of sentence is vacated and remanded for resentencing, where for the purpose of Section 2B1.1 of the Sentencing Guidelines, the intended loss of a credit card fraud is not, in every case, the credit card's credit limit but instead requires deeper analysis as to whether defendant intended the maximum potential loss by "maxing out" each and every credit card number that he fraudulently possessed.
