Fuges v. Sw. Fin. Services, Ltd., 11-4504

In plaintiff's suit against a seller of current title reports, alleging that it willfully violated Fair Credit Reporting Act (FCRA) when it included inaccurate information in a report to plaintiff's lender concerning potential encumbrances on her home, district court's grant of summary judgment in favor of the defendant is affirmed where: 1) no reasonable jury could find that defendant had willfully violated FCRA, because it reasonably interpreted the statute as inapplicable to its activities; and 2) under the standard set forth in Safeco Insurance Co. of America v. Burr, defendant could not be liable as claimed.
