United States Third Circuit
US v. Kouevi, 10-3529
Defendant's convictions for visa fraud and conspiracy to commit visa fraud are affirmed where defendant's argument that the paragraph of 18 U.S.C. section 1546(a), of which he was convicted of violating, does not criminalize activities involving authentic immigration documents is without merit, where the plain language of the statute reveals that the first paragraph must be read to prohibit the possession or use of authentic immigration documents which are obtained by fraud.
