D.K. v. Abington Sch. Dist., 10-2189
District court's judgment affirming state hearing officer's denial of plaintiff's claims against a school district alleging violations of the Individuals with Disabilities in Education Act (IDEA) and section 504 of the Rehabilitation Act is affirmed where: 1) there is no clear error in the administrative findings that plaintiffs failed to prove the applicability of the exceptions to the IDEA statute of limitations; 2) plaintiffs may not invoke common law equitable tolling doctrines in the face of specifically enumerated exceptions governing federal statute; 3) plaintiffs' son received a free appropriate public education (FAPE) and is not entitled to a compensatory education award; and 4) the district court did not err in excluding plaintiffs' proffered evidence.
