United States Third Circuit
ZF Meritor, LLC. v. Eaton Corp., 11-3301
In an antitrust action for allegedly anticompetitive practices in the heavy-duty truck transmissions market, the judgment of the district court is: 1) affirmed as to the denial of defendant's renewed motion for judgment as a matter of law where there was sufficient evidence in the record to establish that defendant engaged in anticompetitive conduct which foreclosed a substantial share of the market and, as a result, harmed competition; 2) reversed as to the denial of plaintiffs' request to amend the expert report to submit alternate damages calculations; 3) vacated as to the entry of injunctive relief against the defendant where plaintiffs lack standing to seek injunctive relief because they are no longer in the heavy-duty truck transmission market.
