In defendant's request for habeas relief from his murder-related convictions and sentence of death, the judgment of the district court is: 1) reversed as to the order vacating the sentence where the district court erred in finding an Eighth Amendment violation; but 2) affirmed as to the denial of relief on defendant's claims of ineffective assistance of counsel and that the prosecution used peremptory strikes to remove female jurors in violation of J.E.B. v. Alabama.
