United States Third Circuit
US v. Navedo, 11-3413
In a conviction for illegally possessing weapons, the district court's denial of defendant's motion to suppress is vacated and remanded where the police lacked probable cause to arrest defendant under the circumstances in this case, because unprovoked flight, without more, cannot elevate reasonable suspicion to detain and investigate into the probable cause required for an arrest.
