HIP Heightened Independence & Progress, Inc. v. Port Auth. of New York & New Jersey, 11-3673

In a suit against the Port Authority of New York and New Jersey, claiming that the renovation of a train station violated the Americans with Disabilities Act (ADA), as well as state laws, the judgment of the district court is vacated in part, affirmed in part and remanded where: 1) there are triable issues of fact related to the feasibility of the schemes within the meaning of the ADA; but 2) the state law claims were properly dismissed on the basis that allowing such claims to proceed would violated the interstate compact between New York and New Jersey that created the Authority.
