Control Screening LLC v. Technological Application and Prod. Co. (Tecapro), 11-2896

In a breach of contract suit involving X-ray and metal detection devices for use in public facilities, district court's grant of a motion and petition to compel arbitration in New Jersey is affirmed where: 1) the district court correctly determined that the petitioner's activities adequately supported a finding of specific jurisdiction because there is ample evidence that petitioner purposefully directed its activities at New Jersey and that virtually all of those activities arose from or related to the contract between the parties, and therefore exercise of personal jurisdiction over the petitioner is neither unfair nor unjust; and 2) because the forum selection provision is "null and void," the district court had the power to compel arbitration within its own district.
