Askew v. Trustees Gen Assembly Church, 11-1916

In a dispute stemming from an internal schism in the Church of the Lord Jesus Christ of the Apostolic Faith, brought by a plaintiff whose membership was terminated, alleging the bishop and officers of the board of trustees misappropriated church assets and breached their fiduciary duties to the church, dismissal is affirmed where: 1) the Religion Clauses of the First Amendment insulates from civil court review the decision by a church leader to terminate an individual's membership in a church; and 2) plaintiff's nonmember status deprives him of standing to assert claims alleging harm to the church.
