US v. Bergrin, 11-4300, 11-4552

In a case against a former federal prosecutor and prominent defense attorney, alleging RICO violations, witness tampering, participating in a cocaine-trafficking conspiracy, and tax evasion, the District Court's evidentiary ruling against the government is reversed as to the exclusion of evidence of the "Pozo Plot". Upon remand, the Chief Judge of the District Court is directed to reassign this matter to a different judge.
