In re: New Jersey Title Insurance Litigation, 10-3343
In a putative class action by title insurance purchasers, on behalf of themselves and similarly situated consumers, appealing the District Court's orders dismissing their state and federal antitrust claims against numerous New Jersey title insurance companies, claiming that defendants collectively fixed title insurance rates in violation of the Sherman Act and the New Jersey Antitrust Act, the District Court's dismissal is affirmed where: 1) plaintiffs do not have standing because they have failed to allege any impending injury; and 2) plaintiffs lack standing to assert their injunctive relief claims specifically because there is no imminent threat that the New Jersey Land Title Insurance Rating Bureau (NJTIRB) will file future rates.
