Banks v. International Renting and Leasing Corp., 08-1603
In a suit that included claims for strict liability, breach of warranty, and loss of consortium arising out of an accident involving a rented van in which the plaintiffs were passengers, summary judgment in favor of the lessor of the van is reversed on those claims, where: 1) the Supreme Court of the Virgin Islands issued a decision allowing lessors to be held strictly liable for injuries resulting from a defective product; 2) since the plaintiffs could pursue a theory of strict liability, the district court on remand could determine whether the plaintiffs could rely on warranties in the rental agreement with the defendant.
