In a dispute between the Pennsylvania Department of Public Welfare (DPW) and the federal Department of Health and Human Services (HHS) about overpayments under the Aid to Families with Dependent Children (AFDC) program, the district court's sustaining of an HHS directive that DPW remit the overpayments to the federal government is affirmed, where: 1) section 116(b)(3) of the Personal Responsibility and Work Opportunity Reconciliation Act permitted HHS to conduct its own audits in addition to the single audit procedure employed by DPW; 2) Pennsylvania was not entitled to retain the federal share of recovered AFDC overpayments under substantive law; and 3) DPW lacked standing for a claim that HHS violated the Freedom of Information Act.
