Quilloin v. Tenet HealthSystem Philadelphia, Inc., 11-1393
In a nurse's collective action against her hospital employer asserting claims under the Fair Labor Standards Act of 1938, as well as several state-based class action and common law claims, the district court's denial of the employer's motion to compel arbitration is reversed, where: 1) the district court did not err in addressing the validity of the agreement to arbitrate; but 2) the plaintiff raised no genuine dispute of material fact regarding substantive or procedural unconscionability of the arbitration agreement.
