Mars Home for Youth v. NLRB, 11-1250
In a case in which the operator of a residential services program for at-risk youth sought review of a National Labor Relations Board finding that its refusal to bargain with a union violated Sections 8(a)(1) and (5) of the National Labor Relations Act, the petition for review is denied and the Board's cross application for enforcement of its cease-and-desist order is granted, where the Board correctly determined that five of the petitioner's Assistant Residential Program Managers were not supervisors under Section 2(11) of the National Labor Relations Act and thus were able to participate in a unionizing vote.
