In an appeal from a judgment of the district court dismissing plaintiff's complaint for medical malpractice and wrongful death under the Federal Tort Claims Act (FTCA), judgment is affirmed in part and reversed in part where under the FTCA the United States: 1) is liable to the extent that a private employer would be in similar circumstances in the same locality; and 2) may avail itself of any judicially- or legislatively-based immunity to which individual defendants would have been entitled if they were parties.
