US v. Duka, 09-2292

Conviction and sentencing of defendants, for conspiring to murder United States military personnel, 18 U.S.C. sections 1114 and 1117, and arising from a terrorist plot to attack several US military bases including Fort Dix, are affirmed where the defendants' principal challenge on the grounds that: 1) their convictions should be reversed because they were based in part on evidence procured under a purportedly unconstitutional provision of the Foreign Intelligence Surveillance Act; and 2) the district court improperly admitted certain out-of-court statements under the coconspirator exception to the hearsay rule, fail.
