Valdiviezo-Galdamez v. Attorney General of the US, 08-4564
In a petition for review of an order of the BIA upholding an administrative denial of petitioner's applications for asylum, withholding of removal and relief under the CAT, petition is granted with respect to asylum and withholding of removal but denied on the CAT where the BIA erred by applying a new standard to determine membership in a “particular social group” and failed to petitioner notice or an opportunity to be heard.
