Malik v. Attorney General of the US, 08-3874
Petition for review of a Board of Immigrant Appeals (BIA) decision sustaining Pakistan native-petitioner's removability from the United States is dismissed where the BIA did not err in: 1) affirming the decision of the Immigration Judge (IJ) that he obtained a visa through a fraudulent marriage; and 2) that 8 U.S.C. section 1256(a) did not bar the institution of removal proceedings against him.
