United States Third Circuit

US v. Gibbs, 10-4294

In an appeal from a judgment of the district court ruling that a prior conviction for wearing body armor while committing a felony is not a predicate offense under the Armed Career Criminal Act (ACCA), 18 U.S.C. section 924(e), judgment of the court is reversed where defendant's conviction for donning a body armor is an ACCA predicate offense because it involved the possession of cocaine with intent to distribute.
