In a petition for review of an order of the BIA removing petitioner, petition is granted with a remand where the BIA erred in dismissing petitioner's appeal as moot because petitioner, a native of the Bahamas, incorrectly identified his appeal as one from an interlocutory ruling rather than from a final order of removal within the meaning of 8 U.S.C. section 1252(a)(1).
