United States Third Circuit

In Re: Mushroom Direct Purchaser Antitrust Litigation, 09-2257

In an antitrust dispute arising from a prejudgment order denying an agricultural cooperative the protections of the Capper-Volstead Act, appeal is dismissed for lack of jurisdiction where a district court order denying a defendant Capper-Volstead Act protections is not effectively unreviewable after final judgment, and, therefore, is not a collateral order subject to interlocutory review.
