Renfro v. Unisys Corporation, 10-2447

In an ERISA class-action alleging breach of fiduciary duty on the grounds that defendants inadequately selected a mix and range of investment options to include in subject plan, judgment of the district court is affirmed where it correctly dismissed one group of defendants as non-fiduciaries with reference to the challenged conduct, followed by a dismissal of action in its entirety as against the remaining defendants, because plaintiffs' claims were implausible where the plan's mix and range of options was reasonable.
